1. The parties
This agreement is between Pikes Peak Web Designs, a Colorado-based sole-proprietor web design studio operated by Jon Ajinga (referred to as "Pikes Peak" or "I"), and the Client (you), an individual or business entity engaging me to design, build, and maintain a website.
2. Scope of services
Under the standard plan, I agree to provide the following:
- Custom-coded website design and development covering up to ten content pages
- Eight operational pages included at no cost and outside the ten-page count: Privacy Policy, Accessibility Statement, Terms of Use, Contact page, Thank-You page, Testimonials page, Style Guide, and Sitemap
- Standard build features: light and dark mode with system-preference detection, responsive header and navigation, an accessible mobile hamburger menu, built-in Pagefind search, privacy-focused analytics, WCAG 2.2 AA accessibility, and CDN-served performance
- The blog system, included, with a paginated index, post template, sticky table of contents, reading-progress bar, share buttons, RSS feed, and BlogPosting JSON-LD schema
- Technical infrastructure files: robots.txt, humans.txt, security.txt, sitemap.xml, RSS feed, 404 page, favicon suite, and Open Graph / Twitter images
- Website hosting on a fast global CDN with SSL
- Unlimited content updates during the term of the agreement
- Direct emergency support for site-down or site-critical issues
- On-page and local SEO foundation (meta, schema, sitemap, structured headings, NAP consistency)
- Ongoing security monitoring and maintenance
3. Fees & payment
Monthly Plan: $175 USD per month (or equivalent in CAD), billed on a consistent monthly cycle, with a 12-month minimum term. After the first 12 months, the agreement converts to month-to-month with 30 days written notice to cancel.
Hourly work outside the standard plan: $100 USD per hour. The standard plan covers the design, build, hosting, security, blog, on-page and local SEO foundation, and unlimited content updates within the scope of your site. Anything genuinely outside that scope, such as custom-built calculators, third-party booking integrations, email-marketing templates, or migrations from an old platform, is billed hourly with a written estimate provided before any work begins.
All prices exclude applicable sales tax. Payments are processed through Stripe, which handles the card or ACH transaction directly. I never see or store your card number on my end of the wire, since Stripe holds all payment information on their PCI-compliant infrastructure and only sends me a confirmation that the charge cleared.
4. Timeline
My target is to design, build, and launch your site within 2–3 weeks of the discovery call, provided you can deliver basic content (logo, photos, services list) in the first week. I commit to doing my part; timelines that slip due to client delays are not my responsibility, but I will keep you informed either way.
5. Your responsibilities
- Provide accurate, honest information about your business
- Review and approve designs within a reasonable timeframe
- Keep your account current and respond to payment issues promptly
- Do not ask me to build anything illegal, defamatory, or infringing
6. My responsibilities
- Deliver a custom-coded, accessible, fast website fit for your business
- Handle hosting, security, and maintenance (Monthly Plan) without extra billing
- Reply quickly to content-update requests on most business days
- Treat emergencies as queue-jumping work and handle them fast on most business days
- Tell you, in plain language, when something is outside scope or unreasonable
- Be the same person who takes your call, writes your code, and ships your updates, not a queue, not a hand-off
7. Ownership
I own the source code and host it on your behalf while the agreement is active. Your domain is always registered in your name and never mine, and your photos, text, and brand assets remain yours throughout the engagement. If you decide later that you would rather own the code outright, I am happy to quote a reasonable buyout, and the conversation tends to be a straightforward one.
8. Cancellation
After the 12-month minimum, either party may cancel with 30 days written notice. Within the 12-month minimum, early cancellation by the Client requires payment of the remaining monthly installments under the agreement. I will not cancel on you without cause unless you materially violate these terms.
At cancellation I will help you transition your domain to a registrar of your choice and provide a clean static export of your content that runs on any host with no dependencies attached. The hosted site itself comes offline at the end of the term unless we reach an alternate arrangement.
9. Confidentiality
Anything you share with me in confidence stays in confidence: business strategy, pricing, internal documents, customer data. I will not share your information with third parties except as required to deliver the services (e.g. your domain registrar, the hosting provider) or as required by law.
10. Warranties & limitation of liability
I warrant that the work will be performed professionally and that the deliverables will be free of my negligent errors at the time of launch. I do not guarantee any particular search ranking, sales outcome, or business result; I guarantee my workmanship and my responsiveness.
My total liability under this agreement is limited to the fees you have paid in the 12 months preceding any claim.
11. Governing law
This agreement is governed by the laws of the State of Colorado, United States. Disputes will be resolved first through friendly discussion, then through mediation, and finally (if needed) in the state and federal courts located in El Paso County, Colorado.
12. Signatures
The version you sign will have signature blocks for both parties, dates, and specific terms for your plan and business. It arrives by email as a Google Docs e-signature request, so signing happens directly in your browser with no printing, scanning, or faxing required.
